    This session will review the structure of a captive program and show how a captive is an ongoing operation that evolves with its risk management in many ways. Furthermore, it will detail how a captive can go through the addition of lines of insurance as well as change through acquisition and merger activities. Session attendees will learn the nuances of managing the level of risk a captive undertakes, and how hard markets, social inflation, and other variables impacts a captive. With specific examples and strategies to limit risk, panelists will demonstrate how various decisions can have an effect on all areas of your program, from the financials to claims to the insureds themselves.

    Learning objectives – Upon completion, participants will be able to:
     
    • Review changes to a captive when the structure of the captive changes and to provide tools and concepts
    • Develop tools to use to review the current risk management concepts employed in a captive
    • Learn what concepts for management of risk are being used by other captives and how risk initiatives change as a captive changes
    • Explain and apply concepts to add new facilities or coverage lines to a captive and/or to merge two existing captives

Helio Risk's General Counsel and Chief Risk Officer Heather McClure, JD, LLM, has decades of experience managing client risk inside law firms and organizations, overseeing risk financing, risk management, insurance procurement, captive operations, and claims and litigation. Prior to joining Helio, Heather was Chief Risk Advisor for the national healthcare practice at Aon, a global risk and insurance services company. Before that, Heather was Chief Risk Officer at the University of Oklahoma’s health system, directing risk, claims, captive operations and insurance structure, including property, cyber, directors and officers, employer liability, workers compensation, provider professional liability, hospital liability, aviation, auto and all other commercial and captive lines. Heather also served as Chief Legal Officer of the system’s captive insurance company, saving the system millions over its years of highly successful operations. Heather’s career began as a trial lawyer defending organizations and medical providers in the law firm setting, trying multiple cases to juries as lead counsel. After ten successful trials, she began a career as in-house counsel to a large organization in Texas, managing people and processes related to risk, claims and litigation. Heather earned a B.A. in journalism with a political science minor and a Juris Doctorate from the University of Oklahoma and a post-doctorate Master of Laws (LL.M.) degree in Health Law from DePaul University, Chicago. She holds certifications as a Professional in Healthcare Risk Management (CPHRM) from the American Society of Healthcare Risk Management and a Mediator Certification from Southern Methodist University in Dallas. Heather is licensed as a lawyer in Oklahoma, Texas and Vermont and has insurance

Mary Ellen Moriarty has been actively engaged in the insurance industry for over 30 years in positions within national insurance brokerages as well as commercial insurance carriers. She joined EIIA in 2002 as the Vice President for Property & Casualty, focusing her extensive insurance experience on the higher education industry group. EIIA maintains two captives, College Insurance Company and College Risk Retention Group. Mary Ellen received a B.S. Northern Illinois University, an MBA from DePaul University, and a Master of Pastoral Studies from Loyola University. She currently holds the Chartered Property & Casualty Underwriter (CPCU), Associate in Risk Management (ARM) and Associate in Captive Insurance (AIC) designations. Mary Ellen is actively involved in CICA, VCIA and NRRA. She is a frequent speaker at both insurance and higher education industry events.


Organization: Lockton Companies


Peter leads Lockton’s Alternative Risk Practice and is based in New York City. His team provides strategic client consultation and support for Lockton’s client service teams. His responsibilities include identifying and qualifying ART opportunities, distribution of current product offerings (e.g., alternative collateral, structured risk, integrated risk and parametric solutions), captive consultation and new product innovation. He has 20+ years of experience in the insurance industry with more than 13 years spent at AIG and more than eight years at Lockton.
